How to Claim Paternity Leave and Pay

If you are eligible for Paternity Leave and Statutory Paternity Pay, the process for applying is straightforward. Follow these steps to ensure you receive your entitlement:

1. Submit a Formal Request

You’ll need to provide your employer with a formal request for paternity leave. This can be done either by completing an online form or using your employer’s specific form if they have one. Your request should include:

  • The baby’s due date (or the adoption matching date, if applicable).
  • Your intended start date for the leave.
  • Whether you plan to take one or two weeks of leave.

Make sure to submit this form at least 4 weeks before you intend to take your leave.

2. Employer Submission

Once you’ve completed the form, submit it to your employer. They will process your request and confirm your paternity leave and pay entitlements.

3. No Proof of Pregnancy or Birth Required

Unlike maternity leave, there is no need to submit proof of pregnancy or the baby’s birth when applying for paternity leave. However, if you are adopting or involved in a surrogacy arrangement, additional documentation or specific legal procedures may apply.
